TourIQ User Agreement

1. Parties

This User Agreement is between Beyond Raw Data, the operator of TourIQ, and the organization or person accepting access to TourIQ. If an individual accepts on behalf of an organization, that individual confirms they are authorized to bind the organization.

2. Service

TourIQ provides software tools for tour operations, including bookings, customers, packages, payments, receipts, invoices, expenses, accounting exports, reporting, staff workflows, vehicles, vendors, diary tools, and related features.

3. Customer responsibilities

• Use TourIQ only for lawful business purposes.
• Ensure all customer, staff, payment, travel, passport, health, child, and sensitive data entered into TourIQ is collected lawfully.
• Give required notices and obtain required consents from customers, staff, and other data subjects.
• Keep account credentials confidential and ensure only authorized staff use the system.
• Review bookings, payments, taxes, reports, exports, and receipts before relying on them for business or legal decisions.
• Do not upload illegal, malicious, infringing, or unnecessary sensitive data.

4. Fees and payment

Fees, billing cycle, payment terms, setup fees, taxes, and cancellation terms will be set out in an order form, invoice, proposal, or written onboarding confirmation. Unless otherwise agreed, access may be suspended for non-payment after reasonable notice.

5. Data protection

The parties agree to handle personal data in accordance with Kenyan data protection law, the TourIQ Data Protection and Privacy Policy, and any signed Data Processing Addendum. The customer remains responsible for the accuracy and legality of data it enters into TourIQ.

6. Confidentiality

Each party must protect non-public business, technical, pricing, customer, payment, and operational information received from the other party and must use it only for the purposes of providing or using TourIQ.

7. Availability and changes

TourIQ may be updated, improved, paused for maintenance, or changed to address security, reliability, legal, vendor, or product requirements. We will use reasonable efforts to avoid unnecessary disruption.

8. Limitation of liability

To the maximum extent permitted by law, TourIQ is provided as business software and is not a substitute for professional legal, tax, accounting, financial, immigration, or travel compliance advice. The liability terms should be finalized in counsel-reviewed commercial terms before signature.

9. Termination

Either party may terminate according to the agreed order form or written onboarding terms. On termination, the customer should export required records before access ends. We may retain records required for law, accounting, dispute, security, fraud prevention, or compliance purposes.
